Update: The Home Office will remove the right of Administrative Review for EU Settlement Scheme applications from 5 October 2023
In the latest Statement of Changes to the Immigration Rules published by the Home Office, the Home Office have announced that there will no longer be a right of Administrative Review for decisions on EU Settlement Scheme applications. The change will come into force on 5 October 2023.
The change affects applications for Pre-Settled and Settled Status, as well as Family Permit applications.
Pursuant to the Citizens’ Rights Agreement, applicants to the EU Settlement Scheme will still have a right of appeal to the First-tier Tribunal, in which a judge shall review the Home Office’s decision.
