Russian Court Upholds and Enforces Decision of German Court, Rejecting Sanctions Argument

On 23 October 2024, the Arbitrazh Court of St Petersburg and Leningradskaya Oblast (Arbitrazh Court) issued a decision upholding and enforcing the ruling of the Stuttgart Land Court concerning an arbitral award. The claimant, a German company, Viavi Solutions Deutschland GmbH, applied to the Arbitrazh Court to enforce the decision of the Land Court of Stuttgart of 27 May 2021 against Vilkom SPB LLC, a Russia-based company. The Stuttgart Court had ordered to pay over EUR 85k and USD 68k, plus interests and costs.

The defendant argued that it had not been notified about the hearing in advance, referred to politically motivated sanctions against Russia, and stated that the Stuttgart Court’s judgment violated public order. 

The Arbitrazh Court dismissed these arguments and indicated that generally recognised principles and norms of international law, as well as international agreements, are part of the Russian legal system. Furthermore, the Arbitrazh Court found no violations of public order and deemed the defendant’s arguments baseless.

The defendant has one month to appeal this decision.
