The Financial Conduct Authority’s decision to fine Neil Woodford and ban him from regulated activity has sent a clear warning to those in senior management roles.
Commenting on the case, Caroline Black, a consultant at Gherson Solicitors LLP, stated:
“The ban of Neil Woodford and fines levied against him and the Woodford Equity Income Fund are a stark wake up call for those in senior positions.”
The FCA’s notice highlighted that despite Mr Woodford being the designated risk owner for liquidity, he attempted to delegate that responsibility. Caroline noted:
“The decision notice makes plain that although Mr Woodford was the designated risk owner for liquidity risks, he had sought to rely on the compliance and risk functions to set liquidity thresholds and raise any concerns. The FCA has roundly rejected this approach and apportioned personal responsibility at the highest level.”
The Woodford case illustrates that regulatory obligations cannot be passed down the chain and accountability ultimately lies with the individuals in charge.
