Caroline Black of Gherson LLP comments on FCA’s watering down of its move to create a ‘Naming and Shaming’ Policy in Compliance Week
Caroline Black of Gherson LLP, is quoted in Compliance Week commenting on the dropping of the FCA’s proposal to publicly name firms under investigation before any findings of misconduct.
She highlights that although the previous aggressive proposal has been dropped, the new watered down approach “subtly shifts the power balance in favour of the FCA” as “despite anonymization, there will inevitably be market speculation regarding anonymised announcements, particularly in niche sectors.”
