Can my child register as a British citizen if born outside the UK?

My child was born abroad and I am a British citizen. Is my child automatically a British citizen?

If you are a British citizen otherwise than by descent (i.e. you were born in the UK or naturalised as a British citizen after living in the UK with indefinite leave to remain), your child, born outside the UK, is likely to be a British citizen by descent.

This means that they are a British citizen, entitled to apply for a British passport, but would not automatically pass on their British citizenship to the next generation born abroad. 

What if I am a British citizen by descent? Can my child still acquire British citizenship?

As a British citizen by descent (meaning you inherited your citizenship from a parent rather than by birth in the UK or naturalisation), your child does not automatically acquire British citizenship if born abroad. However, there are pathways to register your child as a British citizen based on:

  1. Residence in the UK before your child’s birth: If you lived in the UK for at least three continuous years at any time before your child’s birth, it may be possible to register your child as a British citizen. An absences requirement will apply to your three years of residence in the UK prior to your child’s birth.
  2. Family residence in the UK after your child’s birth: If your entire family moves to the UK and resides there for a continuous period of three years after your child’s birth, it may also be possible to register your child as a British citizen.  

What are the benefits of registering my child as a British citizen?

Registering your child as a British citizen provides them with the rights and privileges of full British nationality, including the ability to live, work and study in the UK without immigration restrictions.

Additionally, if your child is registered as a British citizen otherwise than by descent, they can pass on British citizenship to their own children born abroad.

What is the process for registering my child as a British citizen?

The registration process involves submitting an application to the Home Office, providing evidence of your British citizenship, proof of residence in the UK (either your own before the child’s birth or the family’s after), and other supporting documents. It is essential to ensure all criteria are met and documentation is accurate to avoid delays or refusals.

Are there any age limits for registering my child as a British citizen?
