International Commercial Arbitration

Gherson’s multilingual arbitration team advises on complex, and often politically sensitive, commercial arbitrations, with lawyers trained in both civil and common law jurisdictions. The team has deep experience in conducting arbitration proceedings under the leading institutional rules, including LCIA, ICC, SCC, the International Commercial Arbitration Court at the Chamber of Commerce and Industry of the Russian Federation (ICAC), China International Economic and Trade Arbitration Commission (CIETAC) and the Arbitration Foundation of Southern Africa (AFSA). Additionally, we have experience in ad hoc arbitration proceedings, including under the UNCITRAL Rules.
We work with international clients throughout the full life cycle of their dispute from arbitration proceedings through settlement negotiations to obtaining and enforcing arbitral awards.

Our international arbitration practice works closely with our litigation team on matters relating to asset recovery, assisting with the enforcement of arbitral awards in the national courts as well as obtaining interim relief in support of arbitrations.
We advise clients in a number of languages including Russian, Mandarin and Afrikaans.

Representative experience

  • Represented a European bank in an LCIA arbitration in a dispute concerning subordinated loans.
  • Represented the majority shareholder of a Russian oil refinery in an SCC dispute with minority shareholders.
  • Represented a European shipping company in a construction dispute.
  • Represented a Chinese photovoltaic manufacturer before the CIETAC against an Indian counterparty and enforcing the arbitration award worth several million dollars in India.
  • Represented a US chemical products supplier in a CIETAC dispute against a Chinese customer.
  • Represented a bank in recovery of a misallocated share options in an AFSA arbitration.
  • Represented a pension fund against the administrator for poor administration of assets in an AFSA arbitration.
