Can I obtain exceptional assurance in order to remain in the UK?

With the removal of countries from the UK red list, the policy with regards to granting exceptional assurances has also been updated.

Presently, if you intend to leave the UK but have not been able to do so, and you have a visa or leave that expires before 30 November 2021, you may submit a request for exceptional assurance.

You will need to provide evidence of a flight ticket that has been booked in order for you to leave the UK, or provide evidence to demonstrate the reasons why you are unable to leave the UK.

Exceptional assurance protects you from any adverse immigration action or consequences after your leave has expired. This is also particularly important for future immigration applications, as periods of overstaying in the UK can sometimes cause an application to be refused. You are not permitted to travel and gain re-entry to the UK if you have been granted exceptional assurance.

If you have a visa that is expiring before 30 November 2021, and you are unable to leave the UK before your visa expires, it is important that you act carefully to ensure that there are no adverse consequences on any future immigration applications.
