Will the extension of the EU Settlement Scheme prevent eligible European citizens and their family members from being undocumented?
London Mayor Sadiq Khan called for a post-Brexit settlement scheme for European citizens to be extended because of a backlog of 300,000 cases.
The application deadline for the EU settlement Scheme is 30 June 2021. With less than one month to go until the deadline, London Mayor Sadiq Khan called for the settlement scheme to be extended.
As explained in our blog titled Home Office Says 5 Million Applications Made Under the EU Settlement Scheme, millions of applications were made to the EU Settlement Scheme. Khan’s main concerns stem from the backlog of 300,000 cases and European citizens facing a loss of rights, leaving them undocumented and vulnerable to discrimination.
While the extension has not been approved yet, the Home Office has issued guidance on late applications to its EU Settlement Scheme. Applications can be submitted after the deadline, but these applicants will need to demonstrate “reasonable grounds” for applying out of time.
Even with the late application guidance and the call for the EU Settlement Scheme extension, there is still the risk of leaving eligible European citizens and their family members undocumented from next month.
