Important dates for EU Settlement Scheme Applications and what they mean

EU nationals and their family members may be able to apply for status under the EU Settlement Scheme (EUSS) to continue to live and work in the UK lawfully.

However, in order for EU nationals (and their family members) to qualify for Pre-Settled or Settled status, there are two important dates to keep in mind:

31 December 2020

If you or your family are from the EU, Switzerland, Norway, Iceland or Liechtenstein, you must have been living in the UK before 31 December 2020 in order to qualify under the EUSS.

If you are an EU national and you have not resided in the UK before 31 December 2020, you may still be able to enter the UK if you qualify as the family member of an EU national who did enter the UK prior to the deadline (see below).

30 June 2021

The deadline for most people to apply to the EUSS was 30 June 2021.

If you did not apply before this deadline, you may be able to submit a late application if you either:

  • Meet one of the criteria for a late application, or
  • Have ‘reasonable grounds’ for not applying before 30 June 2021

Non-EU national and EU nationals may still be eligible to enter the UK and apply under the EUSS if:

  • You qualify as a ‘family member’ of an EU national (“X”), and
  • X was residing in the UK prior to 31 December 2020, and
  • X has status under the EUSS, and
  • Your relationship with X existed prior to 31 December 2020 (in the case of Durable Partners, this means that you must have lived together for at least 2 years before 31 December 2020);
  • The family relationship continues to exist at the time that you make the application.

If you have made an application to the EUSS before 31 July 2021, you will continue to have lawful leave to remain in the UK whilst your application is pending.
