International Protection
Gherson LLP are pleased to announce that on 21 September 2026, our client, the Requested Person, was discharged under s85(7) of the Extradition Act 2003 by Senior District Judge Goldspring following extradition proceedings brought by a Part 2 Territory seeking our client’s return to serve a sentence issued in absentia.
Our client was discharged after the judge concluded that their non-attendance at trial in the Requesting State could not properly be characterised as a deliberate decision to absent, pursuant to s85(3) of the Extradition Act 2003.
This is a major achievement secured for the Requested Person.
Gherson LLP worked closely with Ben Watson KC of Three Raymond Buildings in this matter.
