UK Immigration – The Latest From Gherson

04 Oct 2021, 03 mins ago

As the world of UK immigration law is continuously evolving, with new immigration routes, new guidance and new rules being implemented regularly by the Home Office, it is essential to keep up-to-date with the latest immigration news and announcements.

We aim to report on the majority of these changes via our blogs. We also often post overviews of the various immigration routes and discuss requirements within the different visa categories.

So what have we been talking about recently?

UK Government to help people to become HGV drivers to ease risk of shortages

Posted: 27 September 2021. Massive queues at petrol stations have become widespread in the UK over the past week as drivers are getting increasingly desperate to fill up their tanks amid the unfolding fuel crisis. This is part of a wider supply chain crisis, which has been caused by the shortage of workforce, and in particular HGV drivers, and exacerbated by both Brexit and the Covid pandemic. In this blog, we discuss the Home Office’s announcement to provide short-term relief for the industries by introducing 5,000 temporary visas for HGV drivers and a further 5,500 for poultry workers to prop up the UK’s supply chains in the run-up to Christmas.

What is ADR?

Posted: 28 September 2021. Going to court may be expensive, stressful and time-consuming, and resolving a dispute by other means can be a good alternative to court proceedings. This is particularly relevant in light of the fact that the majority of cases that are taken to court statistically never reach trial and would be settled beforehand. In this blog, we discuss what is Alternative Dispute Resolution (ADR), and how it may be used to avoid going to court, including negotiation, mediation, and expert determination.

A New International Sportsperson route opens next month

Posted: 28 September 2021. It has emerged that a new consolidated International Sportsperson Route will be soon replacing the current T2 Sportsperson and T5 Creative or Sporting Worker routes. Whilst the core elements of both routes are expected to be incorporated in the new route, including the obtaining of an endorsement, there are also requirements that are expected to be changed, removed or strengthened. In this blog, we discuss the details of the new route, including the retention of the requirement for an endorsement from the UK governing body of the relevant sport, the raising of eligibility requirements for short-term visa holders, and the removal of 3-month entry concession for non-visa nationals.

When is an immigration application considered to be made “in time”?

Posted: 29 September 2021. The issue around what is considered to be an ‘in time’ immigration application has been clarified by the courts in recent case law. This is relevant when submitting an application under the Immigration Rules. In this blog, we discuss what is an ‘in time’ application, and how this affects a further application to be made under Paragraph 39E (2) of the Rules following the refusal of the original application.
